Pilot Terms

These Pilot Terms (“Pilot Terms”) govern your participation in the pilot phase of the Kontext Labs Platform (“Pilot”). By participating in the Pilot, you agree to these Pilot Terms in addition to our standard Terms of Service.

In these Pilot Terms, “Kontext Labs,” “we,” “us,” and “our” refer to Kontext Labs.

Changes to These Pilot Terms

We may update these Pilot Terms from time to time. Changes are effective when posted. If you do not agree to the revised Pilot Terms, you must stop participating in the Pilot.

1. Agreement to Policies

By participating in the Pilot, you acknowledge and agree to be bound by Kontext Labs’:

In the event of any conflict between these Pilot Terms and the standard Terms of Service, these Pilot Terms shall prevail regarding your use of the Pilot features.

2. Confidentiality and Data Restrictions

The Pilot is intended for evaluation and testing purposes. During the Pilot phase:

  • No Confidential Data: You must not upload, submit, or otherwise provide any non-public, sensitive, or confidential files or data to the Services.
  • Prohibited Inputs: You must not submit any information described in Section 4.3 of the Terms of Service, including government IDs, health information, or financial credentials.
  • No Personal Data: You should avoid uploading any personally identifiable information (PII) that is not required for account registration.

Kontext Labs is not responsible for any unauthorized disclosure of confidential information uploaded in violation of this section.

3. Third-Party Disclosure

The features, functionality, and performance of the Kontext Labs Platform during the Pilot phase are considered confidential information of Kontext Labs.

  • No Third-Party Exposure: You shall not expose, demonstrate, or disclose Kontext Labs’ features, user interface, or performance metrics to any third party without prior written consent from Kontext Labs.
  • No Benchmarking: You shall not publish any benchmarking results, screenshots, or competitive analysis related to the Pilot.

4. LLM and Data Processing (Global Inferences)

The Pilot utilizes Large Language Models (LLMs) and AI services that may use global inferences.

  • Data Residency: This means that your data (including prompts and uploaded content) may be processed by LLMs located in regions outside of your project’s primary region or your own geographical location.
  • Consent: By using the Pilot, you consent to the transfer and processing of your data across international boundaries as necessary to provide the AI-powered features.
  • Third-Party Providers: As described in Section 4.2 of the Terms of Service, we may transmit Inputs to third-party AI providers to generate Output.

5. “As-Is” Nature and No Warranty

The Pilot is provided on an “AS IS” and “AS AVAILABLE” basis.

  • Experimental Features: You acknowledge that the Pilot features are experimental, may contain bugs, and may not perform as intended.
  • No Warranties: Kontext Labs disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Feedback

We encourage you to provide feedback, suggestions, or reports of issues (“Feedback”). By providing Feedback, you grant Kontext Labs a perpetual, irrevocable, worldwide, royalty-free license to use, disclose, and exploit such Feedback for any purpose without any obligation or compensation to you.

7. Termination and Data Retention

  • Right to Terminate: Kontext Labs reserves the right to suspend or terminate your access to the Pilot or discontinue the Pilot phase entirely at any time, with or without notice.
  • Data Deletion: Upon the conclusion of the Pilot phase, Kontext Labs may delete any data or content associated with your Pilot account unless you transition to a standard paid plan. It is your responsibility to back up any important data.

8. No Service Level Agreement (SLA)

There are no uptime guarantees or performance commitments during the Pilot phase. Support is provided on a best-effort basis.
